Terms and Conditions

The terms and conditions below are to explain our Agreement with you as a user of the Worthy Cause Gold Exchange Kit service, the Worthy Cause Gold Exchange website(s), and/or as a customer of Worthy Cause Gold Exchange and by using the Worthy Cause Gold Exchange service – either via the website(s), via the Worthy Cause Gold Exchange toll-free phone lines(s), and/or at a Worthy Cause Gold Exchange event, you are indicating your Agreement with these terms and conditions.  Please be advised that these terms and conditions inure to the benefit of Worthy Cause Gold Exchange as well as the American Evangelistic Association, and its successors and assigns.

1. Requirements for using Worthy Cause Gold Exchange. You agree (and you must be) and certify that:

(i) You are at least twenty-one (21) years of age;
(ii) You are the actual legal owner of any and all Items sold or attempted to be sold to Worthy Cause Gold Exchange and/or have been specifically authorized, in writing, to sell the Items to Worthy Cause Gold Exchange;
(iii) You are acting on your own behalf, and unless specifically authorized in writing, not acting as the agent or representative of another person.
(iv) You are certifying that all of the information you provided contained within the Worthy Cause Gold Exchange information form is true and correct; 
(v) You certify that any item(s) delivered to Worthy Cause Gold Exchange is/are free and clear of any and all encumbrances or liens of any type or nature whatsoever.   You further certify that the items are not stolen or borrowed;  
(vi) You agree that any transaction with Worthy Cause Gold Exchange, including but not limited to Worthy Cause Gold Exchange’s purchase of the items will not cause Worthy Cause Gold Exchange to be in violation of any anti-money laundering, anti-terrorism, or any other applicable local, state, federal, or foreign law.
(vii) You do Intend and agree to be legally bound by these terms and conditions.

You agree and understand that Worthy Cause Gold Exchange may request documentation or other proof of compliance with any of these requirements and will assist in providing those as requested by Worthy Cause Gold Exchange.  Thank-you for your understanding and cooperation with this – in advance!

Please note that by requesting, receiving or using a Worthy Cause Gold Exchange Kit, or other similar materials provided by Worthy Cause Gold Exchange, sending to Worthy Cause Gold Exchange any gold, diamonds, jewelry, watches or other property or items, whether using a Worthy Cause Gold Exchange kit or other materials provided by Worthy Cause Gold Exchange or otherwise (individually, an "Item", and collectively, "Items"), or otherwise conducting business with Worthy Cause Gold Exchange, you do represent and warrant that you meet these requirements and are certifying the same.

Please – this is important - You expressly represent, warrant and agree that you have (or if acting on behalf of or as agent or representative of another person, such person has), full, legal and unencumbered title to, and ownership of, every Item that is sent or delivered by you to Worthy Cause Gold Exchange and that you have full authority to solely engage in the transaction with Worthy Cause Gold Exchange.

Also – this is important, too - You do agree that you will indemnify and hold harmless Worthy Cause Gold Exchange from and against any and all claims, suits, investigations, judgments, liabilities, obligations and damages relating to or arising out of the title to, ownership of or lien on any item sold or purported or arranged to be sold by you to Worthy Cause Gold Exchange.

2.            Payment and Return.

1. After Worthy Cause Gold Exchange’s receipt and appraisal of your Item(s), Worthy Cause Gold Exchange will issue a check constituting Worthy Cause Gold Exchange’s  payment for the purchase of your Item(s). Upon Worthy Cause Gold Exchange’s delivery of the check, your cashing, deposit or other endorsement of the check, or your failure to provide timely notice of return as provided in item 2(ii) below, you agree that you are legally bound by the sale transaction and you would not have the opportunity or right to receive your Item(s) back from Worthy Cause Gold Exchange.

1. If you do not wish to keep Worthy Cause Gold Exchange's check and would like your items returned to you, you must call Worthy Cause Gold Exchange at 1-877-628-8619 (toll-free) to provide notice of your return request to a customer service representative within ten (10) calendar days of the date on the check.   Even if you call, you must also return your check to the Worthy Cause Gold Exchange Post Office Box indicated on the top left portion of the check.  If  Worthy Cause Gold Exchange receives your phone call within this ten (10) day period, after receiving your check Worthy Cause Gold Exchange will return your Item(s), without charge to you, within fifteen (15) business days. 

1. Inasmuch as Worthy Cause Gold Exchange is not able to provide written appraisals, you may request a telephone or e-mail quote for your Item(s) in advance of Worth Cause Gold Exchange issuing a check. Upon your acceptance, oral or written, of such quote, you do agree to be legally bound by such transaction, and payment by check will be issued promptly by Worthy Cause Gold Exchange.  In this case, you would not have the opportunity to return your check and receive your items back from Worthy Cause Gold Exchange.  Please note that to memorialize such conversations and negotiations, they may be monitored and/or recorded.

3.     Limitations of liability.

1. Please understand that Worthy Cause Gold Exchange can have no liability for any Item while in transit or otherwise in the possession or custody of any party other than  Worthy Cause Gold Exchange, including, without limitation, any common carrier, customs authority or postal or delivery service.  Please understand that you bear the risk of loss until  Worthy Cause Gold Exchange acknowledges receipt and verification of your Item(s), even if you send Items in a Worthy Cause Gold Exchange Kit or in other materials provided by Worthy Cause Gold Exchange..

1. If you use the Postal Service prepaid Worthy Cause Gold Exchange Kit, in the event of loss of or damage to the contents of a Worthy Cause Gold Exchange Kit, that you properly ship to  Worthy Cause Gold Exchange, in accordance with the instructions and procedures set forth in the Worthy Cause Gold Exchange Kit materials, Worthy Cause Gold Exchange will, subject to these terms and conditions, pay to you (and our liability will be limited to) an amount equal to the lesser of the one-third (1/3) of the appraised value of the lost contents or One Hundred Dollars ($100.00).  Worthy Cause Gold Exchange reserves the right, in its sole discretion, to reject delivery of any mail or package that appears damaged, opened or tampered with. Any such rejected mail or package will be returned to you, and Worthy Cause Gold Exchange will have no liability in connection with any such attempted delivery or return of any Item(s). Accordingly, if you anticipate the value of your Items to be in excess of $100.00, you should send them to Worthy Cause Gold Exchange via UPS or the Postal Service and please be sure to insure your Item(s) against loss in transit to Worthy Cause Gold Exchange for your full anticipated value.

1. In the event of a loss or damage, after Worthy Cause Gold Exchange acknowledges receipt and verification of an Item, if you did not provide Worthy Cause Gold Exchange with an original sales slip or a written third party appraisal (issued prior to delivery to Exchange) for the Item, the value of your Item for purposes of Worthy Cause Gold Exchange's liability will be $33.00.  In the event of a loss or damage after Worthy Cause Gold Exchange acknowledges receipt and verification of an Item, if you did provide Worthy Cause Gold Exchange with an original sales slip or a written third party appraisal (issued prior to delivery to Worthy Cause Gold Exchange) for the Item, Worthy Cause Gold Exchange's liability will be limited to one-third (1/3) of the appraised value of the lost or damaged Item or Five Thousand Dollars ($5,000.00), whichever is less.  . You expressly acknowledge and agree that if you do not provide such a sales slip or appraisal, you agree to accept Worthy Cause Gold Exchange's determination of value as conclusive and binding.

1. In order to make a claim for loss or damage of an Item, you must submit a claim to Worthy Cause Gold Exchange after thirty (30) days and within ninety (90) days of your mailing the Item to Worthy Cause Gold Exchange.  You will need to make such claim on the claim form provided by Worthy Cause Gold Exchange (which is available on request).   Worthy Cause Gold Exchange can not accept or process your claim form unless it is fully and accurately completed, signed and delivered to Worthy Cause Gold Exchange in accordance with the instructions on the claim form. In addition, you must submit all supporting documentation with the completed and signed claim form.

1. Worthy Cause Gold Exchange reserves the right, in its sole discretion, to reject delivery of any Worth Cause Gold Exchange kit, mail, envelope, package or other material that appears damaged, opened or tampered with.  Any such rejected material will be returned to you, and Worthy Cause Gold Exchange, would have no liability for any such attempted delivery or return of any Item(s).

(vii)                        Please – and this is important! 
Except as expressly provided in items 3(ii) and 3(iii) above, Worthy Cause Gold Exchange will have and can assume no liability whatsoever, whether arising in connection with the use of the Worthy Cause Gold Kit service, Worthy Cause Gold web site(s) or a Worthy Cause Gold Kit or other materials provided by Worthy Cause Gold Exchange, the loss of any Item(s), or for any other reason, including, without limitation, Worthy Cause Gold Exchange's own acts or omissions.  You agree that Worthy Cause Gold Exchange will not be liable for any special, incidental, punitive, consequential or other similar damages (including, without limitation, loss of profit or opportunity).

4.            Return insurance liability limitation.   Worthy Cause Gold Exchange will insure any Item returned to you with a value, as determined by Worthy Cause Gold Exchange in its sole discretion, of $15.00 or more at the amount of two (2) times such value (regardless of whether and in what amount it was insured for when mailed by you).   Worthy Cause Gold Exchange will not insure any item with a value, as so determined, of less than $15.00.  If Worthy Cause Gold Exchange receives a written request from you prior to return shipment of your Item(s), Worthy Cause Gold Exchange will increase the amount of insurance as requested by you, provided that you also forward the sum of $20.00 to cover insurance and administrative costs.  Worthy Cause Gold Exchange, in its sole discretion, choose the return carrier, insurance and receipt verification method for each transaction. Except for such insurance obligation, Worthy Cause Gold Exchange will have no liability whatsoever in connection with the return of any Item to you.

5.            Privacy policy.   We respect your privacy and we want you to understand Worthy Cause Gold Exchange's privacy policy, which is posted at www.WorthyCauseGoldExchange.com.  You agree to review this and acknowledge that the Worthy Cause Gold Exchange privacy policy, as amended from time to time, will be binding on you.   Worthy Cause Gold Exchange reserves the right, in its sole discretion, to monitor and/or record any telephone calls made or received by Worthy Cause Gold Exchange.

6.            Legal compliance. Worthy Cause Gold Exchange plans to institute a compliance program under the USA PATRIOT Act.  You may be asked for information to help us comply with such program – thank you in advance for your compliance.

7.            Binding effect. These terms and conditions, including, without limitation, the limitations of liability herein, will be binding on you and all third parties, including, but not limited to, your successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to your transaction with Worthy Cause Gold Exchange. In no event will Worthy Cause Gold Exchange be liable to any third party, including, without limitation, any insurance carrier. Worthy Cause Gold Exchange will not be liable for, and you waive, any subrogation claim brought by your insurance carrier or on your behalf.

8.            Choice of law, waiver and claims.   These terms and conditions, and all Worthy Cause Gold Exchange transactions doing business as Worthy Cause Gold Exchange Kit, will be governed by the laws of the State of Florida without regard to its conflict of law provisions.  Worthy Cause Gold Exchange's failure to exercise or enforce any right or provision of these terms and conditions will not be deemed to be a waiver of such right or provision. If any of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other terms and conditions will remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Worth Cause Gold Exchange Kit or Worthy Cause Gold Exchange service or the Worthy Cause Gold Kit web site(s) or otherwise with Worthy Cause Gold Exchange must be filed within one (1) year after such claim or cause of action arose or be forever barred.  You agree that any such claim or cause of action must be filed in the State of Florida.   You also agree that Worthy Cause Gold Exchange will be entitled to reimbursement for any and all costs incurred by it in defending any civil action filed or attempted to be filed in any jurisdiction outside of the State of Florida, including but not limited to, attorney's fees incurred by Worthy Cause Gold Exchange.
